1. Acceptance of These Terms

Fitness Connected is a product of Zungl LLC. In these Terms of Service, "Fitness Connected," "FC," "we," "us," or "our" refer to Zungl LLC in connection with Fitness Connected.

These Terms of Service ("Terms") govern your access to and use of the Fitness Connected mobile application, website, services, content, features, and related technologies (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy and Health Disclaimer. If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. Continued use of the Service following the effective date of updated Terms constitutes acceptance of the revised Terms. In some cases, we may require you to review and accept updated Terms before continuing to use certain features.

2. Eligibility

You must be at least eighteen (18) years old to create an account or use the Service.

By using the Service, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal authority to enter into these Terms.
• Your use of the Service complies with applicable laws and regulations.

If we learn that an account was created in violation of these requirements, we may suspend or terminate the account.

3. Description of the Service

Fitness Connected is a health, fitness, and wellness platform designed to help users view, organize, compare, and better understand information collected from supported devices, wearable products, health platforms, and other data sources.

Features may include:

• Health and fitness tracking
• Data visualization and reporting
• Trends and insights
• Goal tracking
• Badges, achievements, and streaks
• Social and community features
• Connections and groups
• Rankings and comparisons
• Wellness-related tools and experiences
• Premium or subscription-based features
• Future services and functionality

Features may vary by device, platform, geographic location, subscription status, or availability.

We reserve the right to modify, add, suspend, or remove features at any time.

4. Health and Medical Disclaimer

Fitness Connected is not a medical device and does not provide medical advice, diagnosis, treatment, or healthcare services.

Information provided through the Service, including metrics, trends, insights, recommendations, achievements, comparisons, rankings, and other content, is provided for informational and educational purposes only.

You should not rely on the Service for medical decisions, diagnosis, treatment, emergency response, or determining the presence or absence of any medical condition.

Your use of the Service is also subject to our separate Health Disclaimer, which is incorporated into these Terms by reference.

If you believe you may be experiencing a medical emergency, contact emergency services or seek immediate medical attention.

5. Accounts and Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

• Provide accurate account information.
• Keep your information reasonably current.
• Maintain the security of your login credentials.
• Promptly notify us of unauthorized access or security concerns.

You may not:

• Share your account with another person.
• Allow another individual to use your account.
• Create accounts using false identities.
• Impersonate another person or organization.

We may suspend or terminate accounts that violate these Terms or present security risks.

6. Health Platform and Device Integrations

Fitness Connected may integrate with third-party services, platforms, devices, wearable products, operating systems, and health-data providers.

Examples may include:

• Apple HealthKit
• Apple Health
• Android Health Connect
• Wearable devices
• Fitness trackers
• Health and wellness platforms

Your ability to access and use certain features may depend upon the availability and operation of third-party services.

We do not control and are not responsible for:

• Third-party platform availability
• Device functionality
• Data synchronization failures
• Platform outages
• Changes made by third-party providers
• Third-party calculations or algorithms

Integrations may be modified, limited, suspended, or discontinued at any time.

7. Data Processing and Cross-Device Comparisons

Fitness Connected may collect, import, organize, aggregate, normalize, transform, analyze, compare, and display information received from supported devices and health platforms.

These processes help provide:

• Cross-device comparisons
• Rankings and leaderboards
• Trends and analytics
• Progress tracking
• Achievements and streaks
• Insights and wellness features

Information presented within Fitness Connected may differ from information displayed by the originating platform, device manufacturer, or health service.

Differences may result from:

• Device hardware differences
• Manufacturer algorithms
• Data availability
• Data synchronization timing
• Platform-specific calculations
• Data processing methods
• Fitness Connected calculations and normalization methods

You acknowledge and accept that results displayed within Fitness Connected may not exactly match values displayed by third-party providers.

8. User Content

You may create, upload, submit, or display certain content through the Service, including usernames, profile information, images, links, social media profiles, group content, posts, comments, and other materials ("User Content").

You retain ownership of your User Content.

However, by submitting User Content through the Service, you grant Fitness Connected a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, and distribute such content solely for the purpose of operating, improving, and providing the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content.
• Your User Content does not violate the rights of others.
• Your User Content complies with applicable laws and these Terms.

We reserve the right to remove User Content that violates these Terms or may harm the Service, users, or third parties.

9. Social Features and Community Conduct

Fitness Connected may provide social and community features, including profiles, connections, groups, comparisons, rankings, leaderboards, challenges, messaging features, and other interactive experiences.

You are responsible for your conduct and interactions with other users.

You agree not to:

• Harass, threaten, intimidate, abuse, or stalk others.
• Post or share unlawful, harmful, defamatory, fraudulent, or misleading content.
• Upload, share, transmit, or display sexually explicit, pornographic, exploitative, abusive, hateful, discriminatory, violent, or graphic content.
• Impersonate another individual, organization, or entity.
• Create fake accounts or misleading identities.
• Attempt to manipulate rankings, leaderboards, comparisons, achievements, badges, streaks, rewards, incentives, or platform metrics.
• Use the Service to distribute spam, unsolicited communications, or malicious content.

We may investigate violations of these Terms and may suspend, restrict, remove content from, or terminate accounts that engage in prohibited conduct.

10. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms.

You may not:

• Reverse engineer, decompile, disassemble, or attempt to discover source code.
• Circumvent security measures or access controls.
• Interfere with the operation of the Service.
• Use automated systems to access the Service in an unauthorized manner.
• Scrape, harvest, or collect user information without authorization.
• Introduce malware, viruses, or malicious code.
• Attempt to gain unauthorized access to systems, networks, accounts, or data.
• Use the Service in a manner that violates applicable laws or regulations.

We reserve the right to investigate and respond to suspected violations.

11. Intellectual Property

The Service and all associated content, software, designs, graphics, trademarks, logos, badges, achievements, calculations, algorithms, visual assets, and related materials are owned by Zungl LLC or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, no portion of the Service may be copied, modified, distributed, sold, licensed, or exploited without prior written permission.

Fitness Connected, FC, and related branding elements are trademarks or service marks of Zungl LLC.

Nothing in these Terms grants you ownership of any Fitness Connected intellectual property.

12. Optional Support, Premium Features, and Subscriptions

Optional Support Fitness Connected Payments

Fitness Connected may offer optional ways to support continued development. Each Support Fitness Connected payment is a voluntary, one-time transaction. You may choose to make additional support payments later.

A support payment does not purchase or unlock Premium access, app features, digital content, Early Adopter status, badges, avatar treatment, profile status, preferential access, digital currency, a durable supporter identity, ownership or equity, or promised future functionality. All support amounts have the same outcome within Fitness Connected: our gratitude.

On iOS, optional support purchases may be processed by Apple through In-App Purchase and StoreKit. On Android, optional support contributions may be processed through Stripe-hosted Payment Links or Checkout.

Payment processing, transaction records, and any provider-controlled refund process are subject to the applicable payment provider's terms, policies, and procedures. If you have a payment question or believe a support payment was made in error, you may contact us at fitnessconnected@zungl.com for assistance.

Support amounts and availability may vary by platform and may change over time.

Future Premium Features and Subscriptions

Separately from optional support payments, certain features of the Service may be offered on a paid, subscription, or premium basis now or in the future.

If you purchase a subscription or paid feature:

• Additional terms may apply.
• Pricing may change over time.
• Billing may be handled by third-party providers.
• Access to premium features may be modified or discontinued.

Any subscription terms presented at the time of purchase will govern the applicable subscription offering.

13. Corporate Wellness and Organization Programs

Fitness Connected may offer services through employers, wellness providers, educational institutions, organizations, sponsors, or other third parties.

Participation in organization-sponsored programs may be subject to additional agreements, policies, or program requirements.

Certain features, incentives, rankings, reporting tools, administrative functions, wellness challenges, or organization-sponsored experiences may vary depending on the organization or program involved.

Nothing in these Terms requires Fitness Connected to offer any particular corporate, organizational, or wellness-related program.

14. Third-Party Services

The Service may contain links to, integrations with, or functionality provided by third-party services.

Third-party services may include:

• Device manufacturers
• Health platforms
• Social media platforms
• Analytics providers
• Payment processors
• Cloud infrastructure providers
• Other external services

Fitness Connected does not control and is not responsible for the availability, security, functionality, accuracy, content, or practices of third-party services.

Your use of third-party services is governed by their respective terms and policies.

15. Availability and Changes

We continually improve and evolve the Service.

We may:

• Add features.
• Modify features.
• Remove features.
• Restrict functionality.
• Perform maintenance.
• Suspend or discontinue portions of the Service.

We do not guarantee uninterrupted availability of the Service and are not responsible for outages, delays, interruptions, or technical issues.

16. Termination

You may stop using the Service and delete your account at any time.

We may suspend, restrict, or terminate access to the Service if:

• You violate these Terms.
• Your activities create security, legal, or operational risks.
• We reasonably believe termination is necessary to protect users, the Service, or third parties.

Termination does not limit any rights or remedies available to Fitness Connected under applicable law.

17. DISCLAIMERS

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITNESS CONNECTED DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT:

• THE SERVICE WILL BE ERROR-FREE;
• THE SERVICE WILL BE UNINTERRUPTED;
• DATA WILL ALWAYS BE AVAILABLE;
• RESULTS WILL BE ACCURATE OR COMPLETE;
• THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

18. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITNESS CONNECTED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, PARTNERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES DAMAGES RELATING TO:

• LOSS OF DATA;
• LOSS OF PROFITS;
• LOSS OF GOODWILL;
• BUSINESS INTERRUPTION;
• DEVICE FAILURES;
• THIRD-PARTY PLATFORM ISSUES;
• DATA INACCURACIES;
• USER DECISIONS BASED ON INFORMATION PROVIDED THROUGH THE SERVICE.

IN NO EVENT SHALL FITNESS CONNECTED'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF:

(a) ONE HUNDRED U.S. DOLLARS ($100); OR

(b) THE AMOUNT YOU PAID TO FITNESS CONNECTED DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

19. Indemnification

You agree to defend, indemnify, and hold harmless Fitness Connected and its affiliates, officers, employees, contractors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your User Content;
• Your violation of applicable law;
• Your infringement of the rights of others.

20. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we may provide notice through the Service, by email, or through other reasonable means.

Continued use of the Service following the effective date of updated Terms constitutes acceptance of the revised Terms.

For certain updates, we may require renewed acceptance before continued use of the Service.

21. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.
